Terms of use

1. Purpose

These Terms of Use (the "Terms") set out the conditions for accessing and using the Arestis application ("the Application"), published by Enrique Rizabaev ("the Publisher"). They form a contract between the Publisher and any person using the Application ("the User").

The Application is available on mobile phones (iOS and Android) and from a web browser. These Terms apply to all of these access methods; where a provision concerns only a specific platform, this is stated expressly.

2. Acceptance of the Terms

Using the Application implies full acceptance of these Terms, given when the account is created. If the User does not accept them, they must not use the Application.

3. Description of the service

Arestis is a physical training tracking application that lets users create programs, log workouts (exercises, sets, weights, durations, distances), track their weight and measurements, view progress statistics, be alerted when their rest time ends and share a workout as an image. Some of these features, in particular the end-of-rest alert, are only available in the mobile applications. The Application is provided free of charge.

4. Access and account

Access requires creating an account (email address and password). The User agrees to provide accurate information and to keep it up to date. The User is solely responsible for keeping their credentials confidential and for any activity carried out from their account.

5. Age requirements

The Application is intended for people aged at least 15, the age of digital consent in France. People under 15 may only create an account with the prior consent of a holder of parental authority, who is then solely entitled to consent to the processing of their data.

6. Health and safety warning

Arestis is a tracking tool: it is NOT a medical device and the Application provides no medical advice, diagnosis or prescription.

The User is encouraged to consult a health professional before starting or changing a training program, in particular in case of illness, injury or doubt. Physical activity involves risks: the User acts under their sole responsibility and agrees to stop exercising in case of pain or discomfort.

7. Acceptable use

The User agrees to use the Application in accordance with its purpose, the law and these Terms. The following are prohibited in particular: any attempt at unauthorized access, alteration or disruption of the service; abusive data extraction; any unlawful use or use that infringes the rights of third parties.

8. User content

The User remains responsible for the data they enter in the Application and guarantees that it does not infringe the rights of third parties or public order.

9. Intellectual property

The Application, its structure, source code, design and content are protected by intellectual property law and remain the exclusive property of the Publisher. The Publisher grants the User a personal, non-exclusive and non-transferable right of use, limited to the period during which the Application is used. The personal data entered by the User belongs to them.

10. Availability and changes

The Application is provided "as is" and offered as a beta version. The Publisher strives to keep it available without guaranteeing continuous, uninterrupted or error-free operation. The Publisher may change, suspend or discontinue all or part of the service, in particular for technical or maintenance reasons.

11. Warranties

To the extent permitted by law, the Application is provided without any warranty of any kind, express or implied, in particular as to its fitness for a particular purpose or the accuracy of the statistics calculated. It is the User's responsibility to keep a copy of their important data.

12. Liability

To the extent permitted by law, the Publisher cannot be held liable for direct or indirect damage resulting from the use of, or inability to use, the Application, in particular injuries, loss of data or any harm related to the physical activities practiced. Nor can the Publisher be held liable in case of force majeure or an act attributable to the User or a third party.

13. Term, termination and suspension

These Terms apply for as long as the Application is used. The User may request the deletion of their account at any time from Settings → Account: the account is then deactivated and its data kept for 30 days, during which the User can cancel the deletion by signing in again, before permanent erasure. Full details are on the Delete my account page. The Publisher reserves the right to suspend or delete an account in case of breach of these Terms.

14. Personal data

The processing of personal data is described in the Privacy policy, which forms an integral part of these Terms.

15. Changes to the Terms

The Publisher may change these Terms at any time. The applicable version is the one in force on the date of use; its update date appears at the top of the document. In case of substantial change, the User will be informed.

16. Governing law and disputes

These Terms are governed by French law. In case of dispute, the User is invited to contact the Publisher to seek an amicable solution. Failing agreement, the dispute will fall under the jurisdiction of the competent French courts, subject to the protective rules applicable to consumers.

17. Miscellaneous

If any provision of these Terms were held void or unenforceable, the other provisions would remain in force. The Publisher's failure to enforce a provision shall not constitute a waiver of it.
